This policy explains our registered trademark and copyright rights, what counts as infringement!

Relevant statutory provisions: Copyright infringement and remedies are governed by Section 51 (what constitutes infringement) and Section 63 (criminal penalty — imprisonment from 6 months to 3 years, with fine) of the Copyright Act, 1957. Trademark infringement is governed by Section 29 (conditions of infringement) and Section 135 (civil remedies — injunction, damages, or account of profits) of the Trade Marks Act, 1999.

2          What Constitutes Infringement

The following actions are strictly prohibited and constitute infringement of VihanEVLLP intellectual property.

Copyright Infringement

1. Copying or republishing VihanEVLLP product descriptions, blog articles, or website content without written permission
2. Downloading and reusing VihanEVLLP product photographs or marketing images
3. Scraping website content using bots or automated tools
4. Creating derivative works from VihanEVLLP content without authorization
5. Distributing VihanEVLLP content on third-party platforms (Amazon, Flipkart, social media) without permission

Trademark Infringement

1. Using the name " VihanEVLLP ", " VihanEV", or any confusingly similar name in commerce
2. Selling counterfeit or fake products under the VihanEVLLP brand name
3. Creating fake social media accounts, websites, or WhatsApp groups impersonating VihanEVLLP
4. Using the VihanEVLLP trademark in Google Ads, Meta Ads, or any paid advertising without authorization
5. Registering domain names containing " VihanEVLLP" or variations thereof
6. Using the VihanEVLLP logo, taglines, or brand identity without permission

3          Reporting Copyright Infringement

Email our IP Agent at vihanevllp@gmail.com with the subject line "Copyright Infringement Notice", including:

                    i.            Identification of the copyrighted work — title, URL, registration number if applicable

                   ii.            Location of infringing material — exact URL on www.vihanev.com

                 iii.            Your contact information — full name, address, phone, and email

                 iv.            Good faith statement — that the use is not authorized by the copyright owner, agent, or law

                   v.            Accuracy statement — under penalty of perjury, that you are the owner or authorized representative

                 vi.            Signature — physical or electronic

Submitting a false or misleading infringement notice may result in legal liability under Indian law.

4          Reporting Trademark Infringement

Email vihanevllp@gmail.com with subject "Trademark Infringement Report", including:

1. Description of the infringing use (URL, screenshot, platform name)
2. Your relationship to the trademark (owner, authorized agent, or concerned party)
3. Your contact details
4. Supporting evidence (screenshots, links, purchase receipts)

5          Investigation and Action

Upon receiving a valid infringement notification, VihanEVLLP will:

1. Acknowledge receipt of the complaint within 24 hours, in line with the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
2. Investigate the claim thoroughly and in good faith
3. Take appropriate action — content removal, account suspension, or referral to law enforcement — and aim to resolve the complaint within 15 business days
4. Notify the alleged infringer of the complaint and action taken
5. Respond to the complainant with the outcome

VihanEVLLP reserves the right to restore removed content if a valid counter-notification is received or the complaint is found invalid.

6          Counter-Notification Process

If your content was removed by mistake or misidentification, submit a counter-notification to vihanevllp@gmail.com with subject "Counter-Notification — IP Dispute", including:

1. Identification of removed material — description and original URL
2. Statement of good faith — under penalty of perjury, that removal was a mistake or misidentification
3. Your contact information — name, address, phone, email
4. Consent to jurisdiction — courts in Mathura, Uttar Pradesh, India
5. Acceptance of service — from the party who submitted the original notice
6. Signature — physical or electronic

7          Repeat Infringer Policy

VihanEVLLP maintains a strict repeat infringer policy. Users or entities who repeatedly infringe upon VihanEVLLP or third-party IP rights will face:

VihanEVLLP reserves the right to pursue all available legal remedies against infringers, including:
